Limited Warranty

ATOMIC AI TECHNOLOGY (HONG KONG) LIMITED ("BodyPark", "we", "our", or "us") provides this Limited Warranty to the original purchaser of a BodyPark ATOM device (the "Product").

This Limited Warranty applies only to Products purchased through BodyPark's official website or authorized sales channels and used for personal, non‑commercial purposes.


1. WARRANTY PERIOD

BodyPark warrants that the Product will be free from defects in materials and workmanship under normal use for:

Twelve (12) months from the date of delivery.

Where applicable, consumer law provides for a longer statutory guarantee period; such statutory period shall apply in lieu of this twelve (12) months period.

This warranty applies to:

  • ATOM device
  • Built‑in hardware components
  • Original charging accessories included in the package
  • ATOM accessories

2. WHAT IS COVERED

If a hardware defect covered by this Limited Warranty occurs during the warranty period, BodyPark will, at its sole discretion:

  • Repair the Product;
  • Replace the defective Product;
  • Replace the defective component; or
  • Provide a refurbished replacement product of equal or greater functionality.

Any replacement Product or component will remain covered for the remainder of the original warranty period or thirty (30) days after replacement, whichever is longer.

BodyPark may require the customer to return the defective Product or component to a designated warehouse before or after a replacement Product is provided.

Failure to return a requested Product within thirty (30) days after receiving a replacement Product may result in BodyPark invoicing the customer for the value of the replacement Product.


3. WHAT IS NOT COVERED

This Limited Warranty does not cover:

Gifts or promotional items

  • Resistance band
  • Storage bag
  • Other accessories marked as gifts or promotional items

Normal Wear and Tear

  • Cosmetic damage
  • Scratches
  • Discoloration
  • Other changes that do not result from a defect in materials or workmanship

Accidental or Physical Damage

  • Drops
  • Impact damage
  • Liquid damage
  • Fire damage
  • Abuse or misuse
  • Neglect

Unauthorized Modifications

  • Opening or disassembling the Product
  • Unauthorized repairs
  • Hardware modifications
  • Use of non‑approved accessories that cause damage

Improper Use

  • Commercial use (defined as use in a business, trade, or professional capacity)
  • Use contrary to product instructions
  • Use in unsuitable environments
  • Use outside intended operating conditions

Software and Digital Services

  • Software bugs
  • Service interruptions
  • Internet connectivity issues
  • Third‑party services
  • Membership subscriptions
  • Digital content
  • Data loss

4. MEMBERSHIP AND DIGITAL SERVICES

BodyPark memberships, subscriptions, AI services, training programs, and other digital content are provided separately from the hardware Product.

Unless otherwise required by applicable law, membership fees and digital service fees are not covered by this Limited Warranty and are non‑refundable once activated.


5. WARRANTY EXCLUSIONS

IN NO EVENT SHALL BODYPARK'S LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS LIMITED WARRANTY EXCEED THE PRICE PAID BY YOU FOR PURCHASE OF THE PRODUCT.

BODYPARK SHALL NOT BE LIABLE FOR:

  • Loss of profits
  • Loss of business opportunities
  • Loss of data
  • Loss of use
  • Indirect damages
  • Incidental damages
  • Consequential damages

NOTHING IN THIS LIMITED WARRANTY EXCLUDES OR LIMITS BODYPARK'S LIABILITY FOR:

  • Death or personal injury caused by BodyPark's negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law

To the maximum extent permitted by law, BodyPark's total liability shall not exceed the original purchase price of the Product.

Notwithstanding the above, the liability limitations set forth in Section 15.3 of the Terms of Service shall also apply to claims arising under this Limited Warranty; provided, however, that where Section 15.3 of the Terms of Service imposes a lower cap than the cap set forth in this Section 5, the lower cap shall apply. For the avoidance of doubt, this limitation does not apply to any statutory consumer rights that cannot be limited or excluded by agreement under applicable law.


6. HOW TO OBTAIN WARRANTY SERVICE

To request warranty service, contact: cs@bodypark.fit

Please provide:

  • Order number
  • Product serial number (if applicable)
  • Description of the issue
  • Photos or videos demonstrating the issue

BodyPark may request additional information to verify warranty eligibility.

BodyPark will respond to warranty requests within five (5) business days.

Customers may be required to provide photographs, videos, diagnostic information, or return the Product for inspection before warranty service is approved.

For verified product defects, BodyPark may, at its discretion:

  • Provide troubleshooting assistance;
  • Repair the Product;
  • Replace the defective Product or component;
  • Provide an equivalent replacement Product.

Refunds are generally available only where required by applicable law or where repair or replacement is not reasonably available.


7. SHIPPING COSTS

For approved warranty claims, BodyPark may, at its discretion:

  • Provide a prepaid return label;
  • Reimburse reasonable return shipping costs; or
  • Arrange alternative return logistics.

For claims determined not to be covered under this Limited Warranty, the customer is responsible for all shipping costs, customs fees, duties, taxes, and related expenses.


8. TRANSFERABILITY

This Limited Warranty is non‑transferable and applies only to the original purchaser of the Product. Where applicable, consumer law provides that the warranty is transferable to subsequent owners; such statutory provisions shall prevail.


9. APPLICABLE LAW

Nothing in this Limited Warranty limits any consumer rights that cannot be excluded under applicable law.
